and Warren Disposal to the conditions listed
below and in accordance with the laws of the State of North Carolina in effect at the time of placing a dumpster rental order. Warren Disposal agrees to provide "Customer" with non-hazardous solid waste collection, transportation, and disposal services.
"Customer" agrees to call Warren Disposal at 828-548-3867 and give Warren Disposal at least a one (1) business day notice for service (dumpster delivery, exchange, pickup or relocation). If a "Customer" calls on a Friday, the next business day is Monday, unless Monday is a holiday. If a call for service is received after 12 noon, Warren Disposal can not guarantee service for the next business day. There may be times when a delay could be incurred in servicing your needs due to inclement weather, traffic conditions, landfill or transfer station delays, etc.
If a driver has to wait for the "Customer" to move vehicles, remove material from an overload dumpster, clear an area for delivery, remove material placed in front of a dumpster, wait for a "Customer" to unlock a gate or any other reason that causes a driver to wait, the "Customer" will be charged a $3.00 per minute wait charge
If you cancel your order before 12 PM the business day prior to delivery there will be a Cancellation Fee of $25. If you cancel your order after 12 PM the business day prior to delivery, or the day of delivery, there will be a cancellation fee of $150 to $250 (plus any distance charges or applicable fees). If the dumpster is refused upon delivery there is no refund of the price of the dumpster rental. If the dumpster is in the process of being picked up and the service is refused there will be a no service charge between $150 and $250 (plus any distance charges)
If Warren Disposal attempts to deliver or pick up a dumpster and the dumpster is blocked or a gate is locked or prevented in any way from delivering or retrieving a dumpster (including being turned away) the "Customer" will be charged a $150 to $250 no service fee, plus any applicable distance fees.
"Customer" agrees not to put any hazardous or toxic waste in the dumpster as it is against the law. All hazardous or toxic waste found in the dumpster will become the responsibility of the "Customer". At Warren Disposals’ discretion, Warren Disposal may return the hazardous or toxic waste found in the dumpster and charge the "Customer" a $150 to $250 return fee. At Warren Disposals’ discretion, Warren Disposal may charge "Customer" a disposal fee for the hazardous or toxic waste found in the dumpster as detailed below in disposal fees.
Hazardous or toxic waste includes industrial waste, waste containing asbestos, septic tanks & waste, paint, cleaning solutions, biomedical waste, pesticides, solvents, automobiles, automobile parts, tires, oil, oil filters, oil containers, gas cans, propane tanks, batteries of any kind, appliances with Freon (air conditioners, refrigerators, etc.), Freon aerosol cans, foam aerosol cans, electronics (TV's, computers, monitors, computer parts, radios, etc), hazardous waste (ballasts with PCB's, devices containing mercury, fluorescent bulbs, etc.), telephone poles, railroad ties and household garbage (food garbage). At Warren Disposal discretion, Warren Disposal may charge "Customer", and "Customer" agrees to pay, a disposal fee for the hazardous or toxic waste found in the dumpster as follows:

All equipment furnished by Warren Disposal shall remain the property of the company, however "Customer" shall have care, custody, and control of the equipment and shall bear responsibility and liability for all loss or damage to the equipment and for its contents while at "Customer's" location. "Customer" shall not move or alter the equipment and shall use the equipment only for its intended purpose. "Customer" shall provide unobstructed access to the equipment on the scheduled pick-up day. Warren Disposal is NOT responsible for any damage to "Customer's" property, including walkways, curbing, pavement, driveways, pavers, irrigation, wells, septic or underground utilities resulting from the company's provision of services. "Customer" warrants that the right of way is sufficient to bear the weight and physical dimensions of the Warren Disposal equipment and vehicles. "Customer" understands that lawn damage may occur during a construction/clean-up project.
"Customer" agrees not to over-fill the dumpster beyond the "Max Load" line on the top of the dumpster. An over-filled dumpster may allow debris to fall out and damage other cars and trucks and it is against the law to transport an over-filled dumpster. Warren Disposal reserves the right to refuse to pick up an over-filled dumpster. If over-filled, the "Customer" will be responsible for removing over-filled debris down to the "Max Load" line. An additional charge to the "Customer" of a $150 to $250 may apply. No Service fee will apply.
Each dumpster rental includes a number of days in the rental which is agreed upon within the initial telephone call and email confirmation sent to the “Customer”. A daily rental fee, which is detailed when ordering your dumpster will apply after the included number of days if the dumpster is not emptied & returned or removed at the "Customer" request. If the dumpster is emptied & returned, the next dumpster is considered a new rental and includes the same number of days as the first dumpster.
The "Customer" agrees to indemnify, defend, and save Warren Disposal harmless from and against any and all liability which Warren Disposal may be responsible for or pay out as a result of bodily injuries (including death), property damage or any violation or alleged violation of the law to the extent caused by "Customer's" breach of this Agreement or by any negligent omission or willful misconduct of the "Customer" or its employees, agents, or contractors in the performance of this agreement. Neither party shall be liable to the other for consequential, incidental, or punitive damages arising out of or in connection with the performance or non performance of this agreement.
